Is Treyarch stepping into Infinity Ward's territory?

In today's news, there could possibly be some conflict between Treyarch & Infinity Ward - the two companies responsible for bringing us new Call of Duty games. This debacle stems from the franchise's upcoming game, Black Ops 2. Apparently Game Informer has gotten a hold of some court documents that show how the upcoming game might break agreements between the two companies:

Above is the aforementioned excerpt that shows that IW has a monopoly on titles set in modern day (post Vietnam), the near future, or distant future. While this seems like IW may have a clear cut case against Activision I think that this game wouldn't have lasted as long as it has since Activision should know about policies between their subsidiaries, and wouldn't have let this get too far. Black Ops 2 Pre-Orders Exceed Black Ops 1, MW3

Amazon has recently announced that the amount of pre-orders that they have received for Call of Duty: Black Ops 2 are ten times more then the original Black Ops game. This is also 30% higher then what Modern Warfare 3 had for day one pre-orders.

This is just nuts I don't understand how this franchise still exists but it does, and how it thrives after being bashed yearly by many gamers. I guess some people must really love their horses. Black Ops 2 Trailer Analysis

Just now the trailer for Call of Duty: Black Ops 2 was released. Here are some things that we at AnythingGeek learn after some analysis. The game is set in 2025 but they still use horses (WTF?!). Call of Duty Black Ops 2 Announced & New Pics

As was expected, Call of Duty: Black Ops 2 has been revealed today and there are some new pictures. There is also a video on the site that you are currently unable to watch. We will update the article when  video is shown. Also, the second image down it shows Los Angles so that will be a city in the game.
